The 40-year-old entered court wearing a long-sleeved black shirt, navy skirt and black heels as she testified against her ex-partner, with her blonde hair draped over her shoulders.

«He told me he had to go back to the Blue Mountains, to Mount Wilson, to let this auctioneer go to his mom because she was selling antiques,» Ms. Mutten explained.

«Charlise finished swimming in the pool and said, ‘Can I go with dad, mom?’

She told the court she said: ‘Yes, of course’.

Mr McKay claims Stein was the «last person» to see Charlise and had the opportunity to see her between 7.16pm on January 11 and 10.06am on January 12.

The following day, the jury heard that Charlise was awoken by vomiting and left at Mount Wilson, allegedly in the care of the auctioneer, while Stein traveled to pick up Mrs Mutten.

Ms Mutten told the court that Stein called her to explain the situation and was told the woman had «three children of her own and is practically like a nurse so Charlise is in good hands».

Ken McKay SC, prosecuting, told the court Stein sent Ms Mutten a text message on the morning of January 12 saying «pack your overnight bag».

«To be honest, I thought he was setting us up to escape… it was a surprise they had for me so I wasn’t too sure,» Ms Mutten said.

She told the jury after Stein picked her up from the caravan park they traveled to Sydney where they bought methylamphetamine and injected it in a nearby park and had sex.

The pair then traveled back to the caravan park where Ms Mutten said they would be «intimate again».

«He told me that she (the auctioneer lady) was happy to look after her (Charlise) overnight and that we had some time to spend together,» Ms Mutten said.

“We wanted to be intimate again and spend the night together, but I was too worried about Charlis so I wanted to head back to the mountains.

They drove back to the Mount Wilson building and arrived at 8:44 p.m. to find no lights in the house.

Ms. Mutten told the jury she didn’t think it was weird until Stein said it was.

She said she was ‘trying to be rational’ about Charlise’s whereabouts and assumed the auctioneer took her daughter because she was unwell.

The jury heard that the barrel containing Charlis’ body was found on January 18, 2022, after police went to the scene as a result of going through Stein’s phone.

Stein’s lawyers say it was Mrs. Mutten who shot and killed her daughter on the evening of January 12, 2022.

Phone calls recorded while Stein was in jail were played to the jury earlier in the trial, where he was heard warning his mother that he couldn’t tell her «everything over the phone.»

In the first phone call, which took place on the morning of February 5, 2022, he told Annemie Stein that he had been contacted by the police about the location of the murder weapon and where Charlise was killed.

«They don’t even know anything,» he claimed in the recording.

Annemie told her son «No, but she wasn’t killed at Mount Wilson», to which Stein replied «I know».

The mother continued, «But they said they did.»

«Alleged doesn’t mean s**t, all it means is I’m going to beat the murder charge,» Stein replied.

From February 10, 2022, another challenge was given to the jury where Stein said that Ms Mutten «will be held accountable for everything».

Doubling down that «it’s true», he told his mother that the police had «nothing» and could not «charge» him with murder, but «he saw it happen».

The trial continues before Judge Helen Wilson.
