The chief prosecutor of the International Criminal Court accused Israel of «collective punishment» of Palestinians in Gaza

The chief prosecutor of the International Criminal Court accused Israel of «collective punishment» of Palestinians in Gaza.

In his first comments since Karim Khan asked a judge to approve arrest warrants for Netanyahu, Yoav Gallant and three top Hamas officials, Mr Khan yesterday condemned Israel’s deliberate attacks on civilians.

«You can’t have collective punishment as a common plan,» he told The Times.

«It is perfectly legitimate for Israel to aim to defeat Hamas and get the hostages out, I support that. But the way you engage must be in accordance with the law.”

He cited Israeli targeting of bakeries and wells, the halting of water, electricity and food supplies from Gaza and the killing of aid workers and people queuing for refuge as factors in his decision.

A British barrister said he recently used the UK’s restraint during The Troubles as an example of how Israel should have behaved during its bombing campaign in Gaza.

Despite the series of assassination attempts, bombings and knee-jerk attacks carried out by the IRA, he explained, Britain never chose to simply drop a 2,000-pound bomb on the Falls Road – potentially taking out a few IRA members or republican sympathizers, but killing many more civilians.

«You can’t do that,» he explained, adding that the law is what separates states from terrorists.

Hamas leaders Yahya Sinwar, Mohammed Deif and Ismail Haniyeh were also charged with extermination, murder, hostage-taking and rape and sexual assault in ICC custody.

If approved by ICC judges, all five men will be arrested as soon as they set foot in one of the court’s 124 member states. Israel and the US are not members.
